Accident Claims

Many accidents occur in day to day life. It is something that we do not want to happen, but sadly they can occur and may be things which have happened by chance. If that accident has been caused by someone being negligent, there may be a chance of making a successful accident claim.

Compensation is paid in the form of money. This will not take away pain or bring back someone who has died, but it can help people to feel that at least the person who caused it has had to pay for what they have done.

The law with regards to compensation does not have a specific list of accident or injury types that can get compensation. However, certain conditions do have to be met and a lawyer will be explain what those are and calculate whether a specific accident does qualify for compensation. They should be able to explain what financial gain there might be from making a claim as well.

Car accidents, particularly whiplash, tend to be one of the most common claims made. This is because drivers have a responsibility to look after other people on the road and so if they are not behaving in a safe manner then they will have to pay for any accidents that they have caused.

Claims can also be made from accidents in the workplace where an employer has not provided safe working conditions. Other claims could include medical negligence, dog attacks, holiday accidents, public liability, airline accidents or criminal assaults.

Airline Accidents

Airline accidents such as problems was boarding or alighting can cause quite serious injuries. An injury on a private or commercial plane could be eligible for compensation. If a family member has been involved in a fatal accident on a plane then a claim could be made to cover costs of the funeral as well claiming for the bereavement and if applicable loss of family income.

It can seem more complicated if the accident occurred outside of the UK, but a claim should still be able to be made, either in the country the carrier is based, your home country or your destination. Under the Montreal Convention there are also rules which could allow you to get compensation even if there was no negligence by the carrier.

Compensation can be paid for a number of things. It will compensate for suffering and pain but also for any medical expenses, loss of earnings and loss of amenity. However, you do only get two years after an accident to make a claim and so it is important to contact a lawyer as soon as possible so that you can get the compensation that you are entitled to.

Bus Accidents

Bus accidents can be quite serious. The most common injury from this sort of accident is whiplash. This is caused when the vehicle stops quickly and the body is stretched and strained when the it comes to a sudden stop. There are different severities of whiplash and some symptoms may not even appear until the next day. Some injuries do not last long, but it is possible for the effects to go on for a long time or even be permanent. Symptoms can include lack of mobility, headaches, shoulder pain, dizziness, back pain and neck pain.

If the injury was caused because the bus driver was negligent then you can claim on these grounds. This would be directly form the driver or from the bus company. If another driver caused the bus to have to stop quickly, then you could claim against them.

You have up to three years to make a compensation claim for this sort of injury. How much money you get will depend on how long your injury lasted, what it was and how much it impacted you.

Car Accidents

Most personal injury claims are as a result of car accidents. 400,000 of them happen each year but some people suffer in silence. It is very important to get medical assistance after an accident as a small feeling of discomfort could be found to be something a lot more serious or may get a lot worse if it has not been treated.

Therefore as soon as possible after an accident you should visit a doctor. You should also make notes about what has happened while it is still clear in your mind. You may feel okay, but there may be problems that you have not noticed because of the shock or symptoms that come on later.

Making a claim against the person who caused the accident, can help to cover the costs of medical treatment and any earnings that may have been lost as a result of not being able to work. This can make a significant difference.

You may feel that it is too much hassle to make a claim, especially if you are not feeling well. However, the lawyer should be able to deal with everything for you so it could be much simpler than you think.

Car Recalls

Some cars are made with faults from the manufacturers. Some of these faults are minor, but occasionally there are big faults with vehicles. If this happens and then causes an accident, there are lawyers which can help to claim compensation against those car manufacturers. For example, in January 2010 Toyota Prius recalled cars over problems with brakes and sticking accelerators. In June 2007 Bentley recalled cars over concerns they may set on fire. In December 2007 Vauxhall Corsa were worried about brakes in some models and recalled them. In November 2007 Lexus had fuel pipe problems in some of their cars and so recalled some.

Clinical Negligence

All health professionals have a responsibility for their patients, whatever level they treat them at. If they do not provide the expected level of care then they may be guilty of medical negligence. This could mean not diagnosing a condition properly or not treating it properly. It may also include not getting consent for a procedure or causing a patient to have an injury or deteriorate mentally.

To make a clinical negligence claim, it has to be proved that the healthcare professional was at fault. They or the place they work for has three months to investigate this sort of complaint. It can be a time consuming process to make this sort of claim and may not be very pleasant.

However, if you manage to secure a no win no fee deal with a lawyer, then you will not have to pay their fees if they lose, because they will take out insurance which will cover this cost. This means that there will be no additional stress with regards to financing the claim, which can be very stressful.

Criminal injury

Assault is where an injury is threatened or sustained by someone. This means that the victim is either injured or feels that they have been threatened by someone who had the potential of injuring them and therefore causing them considerable stress. Most assaults do involve physical injury though.

Many people do get assaulted and it is more than often done by someone that they know. There are strict guidelines though, as to whether compensation can be claimed for assault. The injury most be severe enough to qualify for the minimum amount of compensation, medical attention must have been sought and the injuries documented and the police must have been called within 48 hours of the assault taking place.

It is not always easy to fulfil all of these conditions. However, if you seek advice from a personal injury lawyer, they will be able to confirm whether they think that you have got a case which would allow you to get compensation.

Dog Attack

There is a law in place to protect people against dangerous dogs. The 1991 Dangerous Dogs Act stops people being able to own dogs that are bred for fighting such as Pit Bull Terriers and similar breeds. It means that if a dog of one of these breeds attacks someone then the owner is guilty under this act.

It is natural for a dog to protect their territory and so if someone they do not know enters their home, then they will defend it. An attack could cause anything from a minor injury to death and so there could be a case for personal injury compensation. It may be that you are unable to work, have to pay for medical treatment or are psychologically damaged by the attack.

If you are attacked then it is sensible to seek medical attention as soon as possible. You will then need to report it to the police and then seek the help of a lawyer. The police will prosecute the dog owner if necessary and they will be able to help with evidence in court during the injury claim, if necessary.

Fatal Accident

Fatal accidents are not common, but they do occur from time to time. Many happenin the workplace and others happen in road, marine and aviation accidents.

Losing a loved one is very difficult and can cause emotional trauma. There will also be financial implications if the person was the main breadwinner in a family, for example. If the accident was due to negligence, then a claim can be made. Although the money will not come anywhere near to replacing the person lost, it can help to reduce stress levels by meaning that financial problems need not be a worry.

It can be difficult making a claim like this, especially when you are grieving and this is why it is wise to get a lawyer involved. They will be able to clearly explain what compensation you should be entitled to, put the case together for you an represent you in court.

Holiday Accidents

If you have been on holiday in a foreign country and got an illness or injury, then you may geel that making a compensation claim will be complicated. However, if you find a lawyer who is experienced in this sort of thing, you might be able to organise a no win, no fee deal with them.

You will need to be able to prove that the accident was not your fault. If you have a tour operator then making sure conditions are safe is their responsibility or it could lie with the hotel or local authorities.

Holiday claims can be quite complicated but using a specialist lawyer will make sure that you get the compensation you deserve. Even if you were on holiday outside of the EU or booked through a non-UK tour operator, you should still be able to get help. The amount of compensation, will depend on the country you were in as well as the pain you suffered and how much it impacted your holiday.

Industrial Disease

There are a selection of illnesses, infections and diseases that can be caused in the workplace and they do differ in severity. Some people get effected by disease caused by working conditions such as asbestos or get industrial deafness or tinnitus or even skin diseases or vibration white finger.

Although most companies have health and safety procedures in place, some do have poor safety conditions. Sometimes workers are not even aware that it is their job situation that has lead to an illness until a long time after the event and so claim may look back to previous employment to find a cause.

If an employer is found to be the cause of illness them a compensation claim can be made. If a person has died as a result of a work related disease then a claim may be able to made by the family to cover funeral costs as well as compensation for bereavement and loss of income.

There is time period of three years from the discovery of the health problem to be able to make a claim. This means that even if the cause was a long time ago, as long as the illness has not shown up until less than three years ago, a claim may still be able to be made. The amount of money awarded will depend on the type and severity of the illness and how long it has lasted as well as the impact it has on life.

Medical Negligence

It is sad that medical negligence can be a problem which leads to suffering and sometimes even death. When having medical treatment you trust that health provider in being able to improve your health.

If things do not improve or get made worse because they have not acted appropriately then it can be very upsetting. It has even resulted in death and therefore there are medical malpractice cases brought against those who have not done their job correctly.

Money will not take away pain and suffering or bring a loved one back, but it can help with some of the practicalities of life such as reducing stress with regards to costs of extra treatment or lost income. Finding a lawyer experienced in these sorts of claims should take away the stress. They will be able to explain to you what they will do and help you make the claim.

Once you get the compensation, you will be able to stop worrying about money. This should help you to be able to start to move on in your life.

Public Liability

Every company has responsibility for their customers or members of the public. This means that if they own premises, then they need to make sure that they are safe. If there is an injury on their premises, then it could be shown that it was because they were negligent. This is why most companies have public liability insurance in order to protect them if such claims are made.

Often a claim is made because someone has tripped or slipped in a property, perhaps because there has been a spillage or flooring in need of repair. There are a selection of other things which might cause injury as well.

If you do suffer an injury, then you should report it to the organisation so that they can write it in their accident book. It is also a good idea to take photos of the area where you slipped or were injured as evidence. Then you need to get medical attention and keep note of any expenses from that. Then you need to contact a specialist lawyer, who will be able to help you put together a case and make a claim.

Taxi Accident

When you are involved in a road accident and someone else is to blame, whether you are driving, walking or in a taxi, you may be able to make a claim for compensation if you get injured. A taxi driver is responsible for passengers and so should be driving carefully. If they do get involved in an accident because they were not driving carefully enough, then it is fair that compensation be requested form the driver or the company that they work with. If it was another drivers fault, then you will be able to claim against them instead.

Most car accident claims are for whiplash, but there are many injuries that could take place including psychological ones and these can all be claimed for. Injuries could be minor and not last long, but they could also cause permanent disability and the extend and seriousness of them will determine whether compensation will be paid and how much. If you have had such an accident in the last three years, then it can be worth calling a lawyer and finding out whether you can make a claim and how much for.

Train Accident

Accidents on the railway can often be very serious and cause some very bad injuries. If you have been involved in one, then you might be able to make a claim for some compensation. If a family member has been in a fatal accident, their family may be able to make a claim for funeral expenses and possibly loss of income and bereavement.

Many train accidents cause whiplash, which can be a serious condition leading to permanent problems or it can be quite minor. The severity of the condition will determine how much compensation will be paid. If you have had to miss work due to an injury, then loss of earnings can be claimed as well.

You can only claim if the injury happened within the last three years. You will need proof from a doctor or other healthcare professional that you had an injury and the impact on your life as well as the recovery time will also be factors in determining how much compensation you are entitled to.
